These terms apply when you buy a package from JBPK Enterprise (SSM 202103314176 / LA0038735-U, Batu Pahat, Johor, Malaysia). By ticking “I agree” at checkout you accept them.
1. Packages and prices
- Our packages (Presence, Leads, Sales) and their contents are described on our website. The price shown on the website on the day you sign up is your price.
- Prices are in Malaysian Ringgit (RM) and are the same for every customer. We do not negotiate prices or give discounts; if your budget is smaller, we reduce the scope.
- Prices exclude any government tax that may apply in future. If a tax applies, we will tell you at least 30 days before it is added.
2. Payment options
- Option A: a one-time setup fee, then a monthly fee.
- Option B: a monthly subscription fee with no setup fee.
- All fees are charged automatically to your card or bank account (direct debit) through our payment provider. Each monthly fee is charged in advance for the coming month, on the same date each month.
- Work starts after the first payment (setup fee or first month) has cleared.
3. Minimum term and cancellation
- Both options have a minimum term of 12 months from the launch date. After 12 months the plan continues month to month.
- After the minimum term you can cancel at any time with 30 days’ written notice by email. Cancellation stops future charges; there is no refund for the month in progress.
4. Failed payments
- If a payment fails, our payment provider will retry it for up to 7 days and we will notify you.
- If it is still unpaid after 7 days, we pause the service: your website goes offline and monthly work and reports stop until the payment is made. When you pay, we restore the service.
- If a payment remains unpaid for 30 days, the agreement ends under section 5.
5. Ending before 12 months
- If you stop paying or ask to end the plan before the minimum term ends, the service stops and your licence to use the website design and code ends.
- If you want to keep the website, you can pay the remaining monthly fees of the 12-month term. We will then hand over a full copy of the website files.
- We will not take legal action to recover fees for months in which no service was provided.
6. What you own
- Your domain is registered in your company’s name and stays yours in all cases.
- Your content (text, photos, logo, product information) stays yours.
- Website design and code are licensed to you while your plan is active. After you complete the 12-month minimum term, you may request a full copy of the website files at no charge.
- Accounts on third-party platforms (Google Business Profile, Google Workspace, e-commerce platforms, Meta, payment gateways) are opened in your name, with us added as a manager.
7. Delivery and changes
- You agree to send the information, photos and logo we request within 14 days.
- We send the first draft within 7 working days after we receive complete information and the first payment.
- Each package includes two rounds of changes before launch.
- After launch, each package includes a monthly number of change requests: Presence 1, Leads 3, Sales 5. One request is one change (for example, replacing a photo or updating a price). Unused requests do not carry over.
- Extra changes are quoted before we start, or you can add the self-edit mode to make text and photo changes yourself.
8. Third-party costs
Licences and fees charged by other companies are not included and are paid by you directly to them. These include Google Workspace licences, e-commerce platform fees, payment gateway fees and advertising spend.
9. Our 90-day visibility commitment
- On launch day (day 0) we record your baseline: Google Business Profile views and Google Search impressions.
- If, 90 days after launch, neither of these figures is higher than the day-0 baseline, we waive your next monthly fee.
- This applies once per 90-day period and only while your plan is active and payments are up to date. It does not apply if your Google profile was suspended or changed because of information you provided, or if you asked us to pause the work.
- We never promise a specific search ranking.
10. Refunds
- If we do not deliver the first draft within 14 working days of receiving complete information, you can ask for a full refund of the setup fee or first payment.
- Once the first draft has been delivered, the setup fee is non-refundable.
- Monthly fees are non-refundable for a month that has started.
11. Your responsibilities
You confirm that the content you give us is accurate and lawful, and that you have the right to use it. We may refuse to publish content that is illegal or misleading.
12. Limitation of liability
Our total liability under this agreement is limited to the fees you paid us in the 3 months before the claim. We are not liable for loss of profit or business, or for outages of third-party services such as Google, Cloudflare or payment providers.
13. Changes to these terms
We may update these terms. We will email you at least 30 days before a change takes effect. Changes do not alter the price or minimum term you already signed up for.
14. Law and language
These terms are governed by the laws of Malaysia. If the Chinese or Malay version differs from this English version, the English version applies.
